- When should I contact a solicitor about a personal injury claim?
- As soon as you can, ideally well within two years of the date of the accident. The Statute of Limitations sets a two-year clock for most personal injury claims, with limited exceptions. - Will I have to go to court?
- Not necessarily. Most personal injury claims (other than medical negligence) start with the Injuries Resolution Board, which assesses the claim without a court appearance. If the Board does not assess the matter, or the assessment is rejected by either side, the claim can proceed through the courts.
- What information should I bring to the first consultation?
- Anything relevant to the accident and your injuries: photographs of the location and any vehicles involved, accident reports from Gardaí or your employer, names and contact details of witnesses, medical reports or records of treatment, receipts for any expenses incurred, and details of the other party (including insurance information where applicable).
- How long does a personal injury claim take?
- Timelines vary widely depending on the complexity of the injuries, the response of the other side, and whether the matter is resolved through the Injuries Resolution Board or proceeds to litigation. Straightforward claims can resolve within months; complex matters involving serious injuries or contested liability can take longer.
- How are fees calculated?
- Fees are discussed and confirmed in writing at the outset of every matter through a Section 150 Notice. In contentious business, a solicitor may not calculate fees as a percentage or proportion of any award or settlement (Section 150(2) of the Legal Services Regulation Act 2015).
